In 2012, the Ontario Underground Infrastructure Notification System Act was passed, which stipulates that by law, anyone in the province of Ontario must contact Ontario One Call before they dig. In addition to our contact centre, we are also responsible for public education, industry outreach, and compliance.

Position Overview:

The Investigator supports and advances Ontario One Call’s goal of ensuring safe excavation in the province of Ontario. This role requires an in-depth understanding of the locate industry, the Ontario Underground Infrastructure Notifications System Act, the Corporation’s by-laws, court and tribunal procedures, and best practices in modern regulation.

The Compliance & Industry Performance (“CAIP”) team receives complaints of alleged non-compliance. Using an evidence-based approach, the Investigator files complaints, gathers data, conducts thorough investigations and makes determinations. The Investigator also acts as a witness in cases heard before the Court, tribunal, or addressed through arbitration.

The Investigator reports to the Director of Compliance & Industry Performance or their designate. This position is located at the Guelph office located at 104 Cooper Drive in Guelph, ON. Ontario One Call has a hybrid work model with staff dividing their workweek between in-office and at-home work per company policy.

We are currently hiring for this position.

Primary Responsibilities:

  • Interpret and apply the policies and procedures established in the organization’s Act, by-laws, and rules documents for all interactions.
  • Undertake the responsibilities of an Assessor appointed under the Act, including issuing administrative penalties in accordance with Ontario One Call’s internal policies and the Code of Conduct for compliance personnel.
  • Conduct thorough and impartial investigations, primarily from the office.
  • Receive and prioritize complaints collected over the phone and electronically using a risk-informed approach.
  • Conduct investigations (interviews, data compilation) and prepare reports as directed by management.
  • Prepare and compile correspondence pertaining to investigations including letters to contravening parties, complainants, and stakeholders.
  • Review relevant cases and make determinations, which may result in enforcement.
  • Provide testimony at tribunal regarding administrative penalties, and participate in resolutions pursuant to the Not-for-Profit Corporations Act.
  • Ensure a positive image of the organization and maintain effective relationships by providing timely information to stakeholders.
  • Educate the public and stakeholders on the Act/regulations and guide them to establish best practices within the industry.
  • Periodically attend conferences to educate stakeholders on the compliance process.
  • Assist with Ontario One Call projects, initiatives, and procedures to promote compliance with regulatory requirements.
  • Contribute to a workplace environment conducive to a high-performing team by maintaining positive professional relationships with all members of the Ontario One Call team; share expertise and best practices; participate in the training and development of others; and provide backup for colleagues.
  • Additional duties as may be required.

Qualifications:

  • Knowledge of underground infrastructure regulated by Ontario One Call and the excavation industry.
  • Strong communicator, able to clearly deliver messages verbally and in writing.
  • Proficient in the use of MS Office Products such as Word, Excel and PowerPoint.
  • Analytical thinker able to examine complex situations, without bias and in a methodical manner to identify root causes leading to non-compliance.
  • A desire to understand people, processes and issues.
  • Customer service orientation – a desire to identify and service stakeholders, who may include the public, colleagues, partners, co-workers, peer agencies and personnel of the Ontario Public Service.
  • A self-confident individual who is comfortable making decisions and standing behind them. Dedicated to transparency, the incumbent operates with integrity and assumes accountability for their actions.
  • Must have a valid G class Driver’s Licence and the ability to travel throughout the province of Ontario. May require overnight travel.
  • Capable of working both individually and as a member of a team.
  • Highly organized with strong file management skills (gathering and managing documents in an electronic database with a high degree of accuracy).
  • Strong time management, ability to meet deadlines and adapt to changing priorities.

Education & Experience:

  • Post-secondary education in law, justice studies, risk management, engineering, or other relevant field.
  • Minimum 5 years experience working in compliance, inspections, investigations, or legal proceedings.
  • Knowledge and experience in damage prevention and/or risk is a strong asset.
  • Professional Locate Administrator Certification is a strong asset.
