This position is responsible for the comprehensive administration and strategic management of appeals processes, providing advanced legal analysis and drafting support. The incumbent exercises independent judgment in overseeing the procedural and substantive aspects of appeals, ensuring compliance with governing legislation, bylaws, and administrative law principles. The role includes direct correspondence and engagement with appellants, committee members, and senior College staff on complex and sensitive matters. The position provides high-level advisory and operational support to the Registration Appeals Committee (RAC), Accreditation Appeal Committee (AAC), and the Adjudicative Body of Chairs (ABC)
French language proficiency testing will be administered in the recruitment process.
Responsibilities
Administration of Adjudicative Committees:
- Providing direct support to RAC, AAC, and ABC during committee and panel meetings.
- Corresponding with appellants in English or French, as required.
- Preparing reports for Council, Committee Chairs and senior staff..
- Development of meeting materials, training for committee and panel members, supporting the committee/panels in decision-writing.
- Liaising with staff in the Investigations and Professional Conduct, Accreditation and Membership Services Departments of the College.
- Development of policy documents for committee-specific issues/activities.
- Reviewing indexes and case documents.
- Providing legislative and regulatory support to committee/panel members.
Policy Analysis:
- Provide recommendations, prepare reports, analyses, submissions, briefing materials, and correspondence on regulatory issues impacting the College.
- Offer advice on strategic and novel issues impacting the regulatory sector.
- Research and develop legislative proposals impacting the teaching profession.
- Review case law and legislative developments in assigned areas and make substantive recommendations regarding changes to College legislation, regulations, by-laws, policies and procedures.
- Prepare and deliver presentations, position papers, strategic advice, and briefings on policy issues and related activities for senior staff and Council and Committees.
- Provide strategic advice to staff across all departments within a risk management lens.
- Support program design across the College to implement strategic policy and program initiatives.
- Represent the College in education sector meetings and information sessions.
Legal Writing and Research:
- Supporting the work of adjudicators, particularly in a legal writing capacity.
- Conducting legal research, including interpretation and application of legislation and regulations.
- Synthesizing and summarizing large amounts of information.
Stakeholder Engagement:
- Corresponding with appellants, committee members, and other College staff.
- Providing advice and responding to queries to the adjudicative committees as part of their respective panel work.
- Managing assigned projects and activities.
- Providing timely and comprehensive briefings to senior staff, Council members, and stakeholders on issues and activities related to the work of the adjudicative committees.
Qualifications, Skills, and Experience
- Must hold a J.D. or LL.B. from a recognized institution (or equivalent) and be licensed, or eligible for licensing, with the Law Society of Ontario.
- Candidates without current licensure must demonstrate substantial, directly relevant experience supporting adjudicative tribunals, regulatory bodies, or administrative decision-makers in a legal capacity. required.
- A minimum of five (5) years of experience within the regulatory, government or comparable work environments.
- Oral, written and comprehension abilities in English and French and comfort actively working in both languages
- Ability to support the work of adjudicators during panel meetings in order to ensure the legal requirements of their decision have been incorporated into the written decision.
- Legal research experience, including interpretation and application of legislation and regulations
- Legal writing and editing skills, including the ability to synthesize and summarize large amounts of information
- Ensuring accuracy and detail when writing decisions, reviewing meeting materials, corresponding with members/applicants, and other internal and external stakeholders
